Terms of Service
These Terms govern your use of PenPlot. Please read them carefully; by accessing or using the Service, you agree to be bound by them.

1. Agreement to these Terms
These Terms of Service (these “Terms”) constitute a legal agreement between you and PenPlot (“PenPlot”, “we”, “us”, or “our”) governing your access to and use of the website and AI story-writing service available at penplot.co (the “Service”). By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
2. Eligibility and your account
- You must be at least 20 years of age, or use the Service with the consent and under the supervision of your parent or legal guardian.
- You agree to provide accurate information and to keep your account details current.
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- You must notify us at support@penplot.co promptly if you suspect any unauthorised use of your account.
3. The Service
The Service enables you to generate, edit, save, and (at your option) publish short stories and cover images created with the assistance of artificial intelligence. The Service is provided on an ongoing and evolving basis. We may add, modify, suspend, or discontinue any feature at any time, and we may establish or change limits on usage, storage, or output.
4. Credits, plans, and payments
- The Service uses credits to meter AI actions, such as generating and editing stories and creating cover images. Free accounts receive a limited number of credits that reset daily; a paid Pro subscription provides additional credits in each billing period.
- Paid subscriptions are billed through our payment provider, Polar, at the price displayed at checkout. Subscriptions renew automatically until cancelled, and you authorise such recurring charges.
- You may cancel your subscription at any time from your account. Cancellation stops future renewals; it does not give rise to a refund of the current period except where required by applicable law.
- Credits have no cash value, are not transferable, and may not be redeemed for money. Except where required by applicable law, all fees and credits are non-refundable.
- We may change our prices, credit amounts, and plan features. Where a change affects an active subscription, we will give you reasonable prior notice, and your continued use of the Service after the change takes effect constitutes your acceptance of it.
5. Acceptable use
You agree that you will not use the Service to:
- Violate any applicable law, or infringe the intellectual property, privacy, or other rights of any person.
- Create or publish content that is unlawful, defamatory, hateful, harassing, or sexually exploitative of minors, or that promotes violence or serious harm.
- Generate content depicting real persons without their consent in a manner that is deceptive or harmful or that violates their rights.
- Circumvent or attempt to circumvent credit limits, rate limits, content safeguards, or security measures.
- Reverse engineer, scrape, overload, disrupt, or gain unauthorised access to the Service or its underlying systems.
- Access the Service by means of any bot or other automated process, except through interfaces that we expressly provide.
- Resell or otherwise commercially exploit the Service without our prior written permission.
We may remove content, and suspend or terminate accounts, that we reasonably believe to be in breach of these Terms or of any applicable law.
6. Your content and ownership
“Your Content” means the prompts and instructions you submit and the story text, titles, and images generated for you through the Service. You own Your Content. PenPlot does not claim ownership of Your Content, and nothing in these Terms transfers ownership of Your Content to us. You are solely responsible for Your Content, and you represent that you hold all rights necessary to submit it and to grant the licence set out below.
So that we can operate the Service, you grant PenPlot a worldwide, non-exclusive, royalty-free, transferable, and sub-licensable licence to host, store, reproduce, process, adapt, publish, and display Your Content. This licence enables us, for example, to save your stories to your library and to process them through our AI and infrastructure providers. Where you choose to publish a story to the community feed, the licence also allows us and other users to view, share, and remix that story through the features the Service provides, and allows us to feature that published story in materials that promote the Service. The licence is granted solely for these purposes.
You may unpublish or delete Your Content at any time, and we will cease displaying it going forward and the licence above will end, except to the extent that (a) copies remain in backups or with other users who have already viewed, shared, or remixed it, and (b) we are required to retain it to comply with applicable law. This section does not affect your ownership of Your Content.
7. AI-generated content
The Service uses third-party AI models to generate text and images. You acknowledge and agree that:
- AI output may be inaccurate, incomplete, offensive, biased, or otherwise unsuitable, and may not reflect real facts, persons, or events.
- AI output is generated automatically and may resemble output provided to other users or pre-existing works. We do not warrant that any output is original or that it does not infringe the rights of third parties.
- AI output does not constitute professional, legal, medical, financial, or other expert advice, and you should not rely on it as such.
- You are responsible for reviewing and editing any output, for deciding how to use it, and for ensuring that your use complies with applicable law and these Terms.
PenPlot does not endorse, verify, or accept responsibility for any AI-generated content. You use such content at your own risk.
8. Community and moderation
Published stories appear in a public community feed. We are under no obligation to monitor user content; however, we may, at our discretion and without notice, review, moderate, restrict, or remove any content, and limit or suspend any account, including in respect of content that we consider to be unlawful, harmful, or in breach of these Terms.
9. Our intellectual property
The Service itself — including the PenPlot name and logo, and the software, design, and content that we provide (excluding Your Content) — is owned by PenPlot or its licensors and is protected by applicable law. We grant you a limited, personal, non-transferable, and revocable licence to use the Service in accordance with these Terms. No rights are granted to you other than as expressly set out in these Terms.
10. Third-party services
The Service relies on third parties, such as Google (sign-in), Polar (payments), and our AI providers. Your use of those features may also be subject to the relevant third party’s own terms and policies. We are not responsible for any third-party service, and the availability of such services is outside our control.
11. Disclaimers
To the maximum extent permitted by applicable law, the Service, together with all content and output, is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy, and without any warranty that the Service will be uninterrupted, secure, or error-free. You use the Service at your own risk.
12. Limitation of liability
To the maximum extent permitted by applicable law, PenPlot and its operators, owners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, revenue, data, goodwill, or content, arising out of or in connection with your use of, or inability to use, the Service or any AI-generated output, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim, or (b) THB 1,000. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
13. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless PenPlot and its operators from and against any claims, damages, losses, liabilities, and costs (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.
14. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or as necessary to protect the Service or other users. Upon termination, the licences you have granted in respect of already-published content, together with any provisions that by their nature should survive — including sections 6, 7, 9, 11, 12, 13, 16, and 17 — will continue in effect.
15. Changes to these Terms
We may update these Terms from time to time. Where we make material changes, we will revise the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of them.
16. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-laws principles. Subject to any mandatory rights available to you as a consumer under Thai law, you agree that the courts of Thailand shall have jurisdiction over any dispute arising out of or in connection with these Terms or the Service.
17. General
- If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect.
- Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- You may not assign these Terms without our prior consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and PenPlot in respect of the Service.
18. Copyright complaints
We respect the intellectual property rights of others and expect our users to do the same. If you believe that content available through the Service infringes your copyright or other intellectual property rights, you may submit a complaint to us at support@penplot.co.
Notice of infringement
Under the Copyright Act B.E. 2537 (1994) and other applicable intellectual property law, please include the following in your notice:
- Your contact details — name, address, email address, and telephone number.
- Identification of the work in which you claim copyright or other rights.
- Identification of the allegedly infringing content and its location within the Service, in sufficient detail for us to locate it.
- A statement that you believe in good faith that the use is not authorised by the rights holder, its agent, or the law.
- A statement that the information in your notice is accurate and that you are the rights holder or are authorised to act on the rights holder’s behalf.
Counter-notice
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may send a written counter-notice to support@penplot.co that includes:
- Your physical or electronic signature.
- Identification of the content that was removed and the location at which it appeared before removal.
- A statement, made in good faith, that the content was removed as a result of a mistake or misidentification.
- Your name, address, telephone number, and email address.
Where appropriate, we may forward your counter-notice to the party that submitted the original complaint.
Repeat infringers
In appropriate circumstances and at our discretion, we may restrict access to the Service, remove or disable content, and suspend or terminate the accounts of users who repeatedly infringe the intellectual property rights of others. In deciding what action to take, we may consider the number and severity of the infringements, the user’s cooperation, and the resulting harm.
